Default Use of Phot's and crediting....

Hi Guys,

Just been reading an article in C&D and realised one of my photo's has been used without accreditation..... bit miffed at this, is it a bit sad to ask for redress of the situation????, I have no problem with them using the photo's, but it's clearly noted as my photo' on the three sites it's on.... I would just like it credited to source.

Any thoughts?

Tom,

I think you have a more than valid point here, and certainly not sad to seek any kind of redress, in my opinion.

I have found images from this forum frequently 'lifted' without permission and/or accreditation for use elsewhere, particularly so by a certain member of the GWF who seemed to have a couldn't-care-less attitude when approached.

Without wishing to take your thread off in a different direction, does anybody know what the forum's stance is on 'protection' of members' images?

I had one of mine used in the OMRS Journal without permission a few months back.

Copyright of images is simple. If you created it, It's yours or your NOK until 70 years after your death. you don't have to have it marked copyright or anything. If someone is lifting images and placing them on another site then you have lost control of it and they are breaking the law. Try it with Getty images to see the potential cost. If they catch you, you will receive a bill for a large sum and you will eventually pay it, because they will have the infringement verified by a copyright solicitor with his affidavit and you are toast, no way out.

Anyone can do this. That is the risk you run copying work still in copyright.

Unless the law has changed since the last time I went throught this annoyance, I got the persons address and paid 25ukp to a solicitor to send a threatening letter. If you actually know who did it and have proof, surely they are breaking copyright law... Why, oh why can't they be 'named and shamed' - or is it the same situation that occured on this forum about a dealer - and 'one' can do absolutely nothing.
Anyone who has wanted to use any of my pics, has always, so far asked.

I also seem to recall being given advice at the time that the 'copyright of xxx' should appear on the picture?? - not sure about whether this is still valid or not in these PC/litigating times.......

I think it is true to say that almost everybody here is good-natured and rarely has major objections to sharing images. What comes through whenever I have read such threads on this forum is that it would be nice to have been asked first. I don't think any of us would particularly mind if someone wished to use one of our images in some minor way, but to just take our pictures without so much as a 'please' really gets up your nose.

That said, there are many examples where members have copied and pasted eBay images to embellish points made within forum threads, especially where the thread concerns the object depicted in the image. How many of us can say we have sought prior permission so to do? This is one reason why I think inserting a link is preferable to pasting such images, though I now some forum members have the odd objection to eBay links as opposed to image inserts, but it does negate the issues surrounding image ownership rights.

This aside, the fact remains that if you created an image, it belongs to you and nobody else.

Tom, I can understand you being miffed, but as you say there's no problem them using the photos, why not just contact the Editor and ask for acknowledgement and a written apology? After all, I take it, unlike Getty who sell there images, you have not suffered by the inclusion in C&D?

LOLS, thanks guys, my father thought it a little sad of me to chase them but tbh if they'd just put taken from www........ picture by Thomas Paffett, I'd have been happy as larry, but to have every photo's credited but mine annoyed me a touch...

I will chute them an email
